Terms of service

These Terms of Service ("Terms") govern your use of marketdwellings.com and any services operated by Market Dwellings LLC ("Market Dwellings," "we," "us," or "our"). By using the site or placing an order, you agree to these Terms.

If you don't agree, please don't use the site.

Who can use Market Dwellings

You must be at least 18 years old and legally able to enter into a contract to use the site or place an order. If you're using the site on behalf of a business, brokerage, or other entity, you confirm you have authority to bind that entity to these Terms.

We currently ship to addresses within the United States only.

Your account

When you create an account, you agree to provide accurate information and to keep it current. You're responsible for keeping your password secure and for everything that happens under your account. Tell us right away at hello@marketdwellings.com if you think your account has been used without your permission.

You can close your account any time by emailing us. We may suspend or close an account that violates these Terms, that we reasonably suspect of fraud, or that we believe puts other customers, our team, or our business at risk.

Products are made to order

Nearly everything we sell is custom-printed to your specifications after you place your order. This has a few important consequences:

  • Orders can usually be cancelled if you reach out quickly — but once production has begun, we can't cancel or change an order.
  • Returns and exchanges are limited. See our Refund policy for details.
  • You're responsible for reviewing your proof (where one is provided) and for the accuracy of the information you submit — spelling, phone numbers, addresses, photos, logo placement, color choices.

Orders, pricing, and payment

All prices are listed in US dollars and do not include applicable taxes or shipping, which are calculated at checkout.

Placing an order is an offer to buy. We can accept or decline any order — including after a confirmation email has been sent — if we discover a pricing error, a stock issue, suspected fraud, or a violation of these Terms. If we cancel, we'll refund any payment received.

We accept the payment methods shown at checkout. Payment is due at the time of order. By paying, you authorize us (through our payment processors) to charge the method you selected.

We sometimes run promotions, discount codes, and volume-pricing tiers. Unless stated, promotions can't be combined, apply to future orders only, and can be changed or ended at any time.

Your content and intellectual property

When you customize a product — by adding text, uploading a photo, uploading a logo, or creating a design — that content is yours. You keep all intellectual-property rights you already had in it.

By submitting your content to us, you grant Market Dwellings a non-exclusive, worldwide, royalty-free license to store, reproduce, print, ship, and display your content for the purpose of filling your order, letting you reorder later, operating the site, and providing customer service. This license ends when we delete the content (see our Privacy Policy for retention timelines), except to the extent we need to keep a record for legal or accounting purposes.

You promise that:

  • You own your content, or you have the rights and permissions to use it and let us print it.
  • Your content doesn't infringe anyone's copyright, trademark, right of publicity, or privacy.
  • Your content isn't defamatory, misleading, obscene, hateful, or illegal.
  • If you upload a real estate brokerage logo or trademark, you're authorized to do so.

We may refuse to produce an order if content appears to violate any of the above, infringes a third party, or that we otherwise find objectionable. If we refuse a production run, we'll refund the order.

Our intellectual property

The Market Dwellings name, the Market Dwellings logo, our product templates, our site design, our marketing copy, our photography, and all other content we create are owned by Market Dwellings LLC or licensed to us. You may not copy, reproduce, modify, distribute, or create derivative works from our intellectual property without our written permission.

Nothing on the site grants you a license to our trademarks or copyrighted material beyond the limited right to view and use the site for its intended purpose.

Reviews, comments, and submissions

If you submit a review, comment, photo, or other public content, you grant us a non-exclusive, worldwide, royalty-free license to display, publish, edit (for length or clarity), distribute, and use that content to promote Market Dwellings, across any media. You can ask us to remove your review or photo at any time.

We moderate reviews only for spam, profanity, off-topic content, or content that breaks these Terms. We don't edit star ratings or the substance of negative reviews.

Prohibited uses

You agree not to:

  • Use the site for any illegal purpose or in violation of any law.
  • Infringe anyone else's intellectual property rights or privacy.
  • Transmit viruses, malware, or any code intended to harm the site or other users.
  • Attempt to reverse-engineer, scrape, or extract data from the site beyond what's permitted by our robots.txt and normal browsing.
  • Interfere with the site's operation, security features, or other users' experience.
  • Use the site to send unsolicited marketing, spam, or bulk communications.
  • Impersonate another person or misrepresent your affiliation with any person or entity.
  • Resell our products or use our templates to compete with us without written permission.

Third-party services

The site integrates with third-party services — payment processors, analytics, reviews, loyalty, email marketing, ad pixels, customer service tools, and others described in our Privacy Policy. Those services have their own terms and privacy policies, and we're not responsible for them. Your use of those services is between you and the provider.

Third-party links

The site may link to websites we don't operate. We don't endorse and aren't responsible for their content, products, or practices.

Disclaimers

The site and our products are provided "as is" and "as available." To the fullest extent permitted by law, Market Dwellings disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We don't warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that the site or the servers that host it are free of viruses.

Some jurisdictions don't allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Market Dwellings, its officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost goodwill, or business interruption, whether based on contract, tort, strict liability, or any other legal theory, even if we've been advised of the possibility.

Our total liability to you for any claim arising out of or related to your use of the site or our products is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) one hundred US dollars (USD $100).

Some jurisdictions don't allow the limitation of incidental or consequential damages, so some of these limitations may not apply to you. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Market Dwellings LLC, its officers, employees, contractors, and service providers, from any claim or demand — including reasonable attorneys' fees — made by any third party and arising out of (a) your breach of these Terms, (b) your content, (c) your violation of any law or third-party right, or (d) your misuse of the site or our products.

Termination

We may suspend or terminate your access to the site or to specific features at any time, with or without notice, if we reasonably believe you've violated these Terms, committed fraud, or put Market Dwellings or other customers at risk. The sections of these Terms that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of Nebraska, United States, without regard to its conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.

Disputes

We hope any dispute can be resolved by talking to us first. If you have a problem, please email hello@marketdwellings.com and give us a chance to fix it.

Any claim not resolved informally must be brought exclusively in the state or federal courts located in Douglas County, Nebraska. You and Market Dwellings each consent to the personal jurisdiction of those courts.

Any claim must be filed within one (1) year after it arose, or it is permanently barred, to the extent allowed by applicable law.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top. Your continued use of the site after changes means you accept the updated Terms. If a change is material, we'll take reasonable steps to notify you.

Other legal bits

  • Severability: If any part of these Terms is found unenforceable, the rest still applies.
  • No waiver: If we don't enforce a right, that doesn't mean we've waived it.
  • Assignment: You can't assign your rights under these Terms without our written consent. We can assign ours in connection with a merger, acquisition, or sale of assets.
  • Entire agreement: These Terms, together with our Privacy Policy, Refund policy, and Shipping policy, are the entire agreement between you and Market Dwellings regarding the site.
